        Public Comment:

Mr. David Crookes, 27 Fin Way, Mashpee commented regarding the actions of William Blaisdell, a member of the Zoning Board of Appeals speaking publicly in favor of a specific candidate campaigning for a seat on the Board of Selectmen.  Mr. Crookes indicated that this action was found distressing.  After consulting the State Ethics Commission, the public actions of Mr. Blaisdell was deemed a violation of the use of his position and voice in support of an individual running for election.   Mr. Crookes indicated that he submitted a letter to the Town Clerk specifically addressed to the Board of Selectmen dated May 19, 2015 with respect to this regard.  Questioning this action as unfair and biased, Mr. Crookes requested the Board of Selectmen consider this matter a worthy cause for investigation and stated that it is appropriate for the Selectmen to hold Mr. Blaisdell accountable for his actions.

Mr. Crookes further questioned the process of the Board of Selectmen to receive and respond to notice.  Appreciation was given to Selectman Gottlieb, as he solely acknowledged Mr. Crookes email.  It was explained the lack of answers is distressing, and reflects a lack of transparency.  It was disclosed by the Selectman Chair that it is not a practice of the Board of Selectmen to respond to comments made during Public Comment.  However, Selectman Cahalane expressed appreciation to Mr. Crookes and indicated the Board of Selectmen was in receipt of the letter of May 19, 2015.

In other business, Mashpee resident Barry Saul discussed accessibility issues with respect to the Town Beach.  Mr. Saul indicated that elderly and disabled persons lack the ability to access the beach as a result of two large boulders impeding the entrance and because the stairway banister to the beach is not fully connected to the entire length of stairs.

        Jason Tanser indicated he was present as an observer, and did not offer comment.

Richard Early stated that he is in agreement with Selectmen Gottlieb’s observation regarding the Selectmen’s decision on Wednesday evening to appoint the Town Manager as an action not deemed appropriate until the Selectmen’s regularly scheduled meeting.  Mr. Early indicated that he is pleased the matter is on the agenda tonight to reaffirm the appointment of Town Manager.

With regards to waste management, Mr. Early indicated the most effective way to reduce trash is with the pay-as-you-throw (PAYT) program.   Mr. Early explained the current system is neither fair nor equitable, especially for those on a fixed income.  With the PAYT, the Town would realize a considerable reduction in costs and trash consumption.

        APPOINTMENTS & HEARINGS:

        Joint Base Cape Cod – Military Missions and Initiatives Update:
        
Major Nathan Wilder, Executive Director of Joint Base Cape Cod (JBCC) was in attendance with other base commanders to annually update the Board of Selectmen and interested public on military missions and initiatives at Camp Edwards, the largest military training base on Cape Cod.  Site improvements include the newly constructed unit equipment training maintenance shop and a regional training institute.  Major Wilder indicated the military has been working closely with MA DEP and the EPA to conduct safe management practices on all firing ranges.  It was noted that environmental improvements have been incorporated into the pistol ranges.  New technology advances include the use of copper bullets and the capture of projectiles.  Lead bullets are fired into a collection system.  Clean-up projects are ongoing for water and unexploded ordinances in the training area.  And, as a future energy saving project, a new photovoltaic system is planned.

With regards to physical security on base the Board was informed the training area is not open for ATV/dirt bike recreation.  Violators are reported to the State Police and/or the MA Environmental Police who hold jurisdiction on this encroachment.    

Recreational hunting for deer and wild turkey is also offered at the base during scheduled times.  The area is heavily forested, and burn management is practiced with local police and fire units.

Air National Guard Colonel James Lefavor, Commander of the 102nd Intelligence Wing indicated the 102nd is continuing cyber domain intelligence.   However, this division is reducing its manpower due to governmental cut backs.  Although the Coast Guard has taken the airfield property under their domain, the real estate footprint is being downsized by approximately 3,000 acres.  Water, wastewater and electricity are managed by the 102nd and funded by National Guard Bureau.  With regards to the matter of regionalization with respect to wastewater, there is no physical solution to date.  If the wastewater treatment facility is declared as excess, there is a possibility of privatization.  It was noted the WWTP is relatively small, currently using about ½ of its capacity.  In support of continued use of the wastewater treatment facility, Major Lefavor welcomed the Town of Mashpee to continue this dialogue.

This summer, fighter alert presence is again anticipated with the President’s annual visit, and as a result, air activity is projected to increase.

        APPOINTMENTS & HEARINGS:

        Joint Base Cape Cod – Military Missions and Initiatives Update:

David Anderson gave an update on the Cape Cod Air Station, the home of Pave Paws.  The mission of Cape Cod Air Station is to surveil, seek and track missiles, astronauts and the international space station.  This active military division tracks approximately 20 launches, mostly from Cape Canaveral.  Approximately 3 million observations are viewed annually.  Mr. Anderson also expressed appreciation to the Town of Mashpee for its community support.

All divisions work to reduce environmental impacts.  Wind turbines on site generate nearly $1,000,000 per year in energy credits.  For efficiency, there have been technology improvements which include the radar water chiller replacement and a security upgrade to better detect animals and intruders on site.  

Coast Guard Captain Steve Torpey, Commander of Air Station Cape Cod indicated that last August the Air Station transitioned to Joint Base Cape Cod.  Several rescue highlights were notable.  This includes the blizzard and recovery of several Australians, a newborn delivery on Martha’s Vineyard, a medivac flight aboard the Queen Mary II, and the POTUS visit to showcase the base facilities.  Upcoming events in the planning stage include the air show scheduled to be held on August 26, 27, and 28th, 2016 featuring the Blue Angels.  The base will also be receiving FAA and Fed Ex shipments.

Joint Base Cape Cod has a new barracks facility, and a medical clinic accredited for ambulatory health care.

The Board of Selectmen opened the Public Hearing on the private to public road conversion of the following roads: Sunset Strip, Noisy Hole Road, Claulise Lane and Wilann Road as shown on plans entitled “Easement Taking and Layout Plan of Sunset Strip” dated January 8, 2010, “Easement Taking and Layout Plan of Claulise Lane” dated January 14, 2010, and “Easement Taking and Layout Plan of Wilann Road’ dated January 14, 2010, prepared by Eagle Surveying, Inc.

        The Hearing notice was read aloud into the record in accordance with posting procedures.

It was disclosed the total estimated betterment cost is $844,487.70.  The maximum cost to be borne by each of the 75 property owners $11,259.84.  The estimated cost includes construction, processing, engineering and recording fees, and a 5% interest charge.  This is the maximum allowable charge by the Town of Mashpee for this betterment.  It was noted the betterment assessment can be paid in full to avoid interest fees or be distributed over a 20 year period.  

Approximately forty area residents were in attendance to review this matter with the Board of Selectmen.  The Board opened the Hearing to solicit comment.

A resident questioned the cost amount as appears to be high and if all neighborhood roads need to be reconstructed.  The question was also asked if the area would receive sewering soon and if the state would be assisting the homeowners.  In response to the questions, it was noted that it is not the state, but the Town of Mashpee.   The original petition as received by the Town of Mashpee is for the reconstruction of all of the roads as listed.  The betterment assessment is the maximum amount to be charged for the road reconstruction and related road taking.  With defined cost specifications, if the betterment fee is less, the property owners would be charged less.  The matter of sewers at this time is unknown.  

A question was asked regarding the pricing, and if it is a rated job.  In response, and through the bid process, some of the projects require the prevailing wage rate.  The figures are determined by the individual lots, and assessed to each property owner.

        Sunset Strip, Noisy Hole Rd, Claulise Lane & Wilann Rd:

Area resident, Elizabeth Walton asked when the project would start.  The Town Manager indicated with receipt of the required second petition, the road taking would be placed before the voters at the October Town Meeting.  Approval at the October Town Meeting would allow for immediate work to be conducted on Sunset Strip to make the road plow-able.  The remainder and bulk of the road work would be conducted in the spring of 2016.  The required petition must be submitted to the Office of the Board of Selectmen/Town Manager by the first Monday in July to adhere to posting requirements for the Town Meeting warrant.  Copies of the petition were made available to the public for the required signatures.

Marie Hetherman of 38 Claulise Lane asked how the road is designated as a private street.  Ms. Hetherman stated that when she first bought her home, she was assessed a water betterment, but she uses well water.  The Town Manager informed Ms. Hetherman that it was likely the road was designated as a private road by the developer.  The Town of Mashpee did not purchase the property from the developer.  Regarding the water mains, they were installed by the Mashpee Water District.  It was also noted the Town of Mashpee owns conservation land in the area and is exempt from paying the betterment as the Town would not be bettering itself with the road taking.

Tom Fudala, a resident of 16 Wilann Road indicated there have been changes to the specifications.  This includes the increased fee for tree work.   In FY 2012, the tree work was projected to cost $1,200, but it is now estimated to cost $2,500.  The initial specification did not include street sweeping and police detail, but it is now reflected in the FY16 conversion estimate.  Mr. Fudala also stated that asphalt paving at a depth of 4” is proposed.  It was explained that 90% of the streets in town have a pavement depth of 2 ½”.   Mr. Fudala indicated that what is being proposing at 4” seems excessive for a residential street without heavy traffic.  Mr. Fudala requested the Board consider a 3 ½” depth which would conform to the Planning Board’s specifications.  In response, the Town Manager stated that 4” in this area would bring the road to Town standards.

Catherine Laurent, the Director of Public Works stated that as per the subdivision regulations, the pavement depth is dependent on the size of the homes, and therefore, the 4” asphalt is required on Sunset Strip.  The additional homes may not require the extra ½” of asphalt.  With the final engineering plans, all configurations would be detailed in the specifications.

Steve Matson, residing at 121 Sunset Strip asked about the road drainage, and existing catch basins.  In response, the DPW Director indicated that it assumed there is no maintenance related to the catch basins.  However, it is assumed the drainage structures may have failed.  The Town anticipates installing new leach systems for additional drainage and using the existing basins as solid catch basins.

A Mashpee resident Anastasia Pundik of 65 Wilann Road stated that she was informed by a Town worker that Wilann Road is a town road, and the town as she understands should be responsible for the maintenance of roads.  The Town Manager informed the Ms. Pundik that Wilann Road is a private road and possibly she was misinformed by a town worker.  When asked if the residents could file an additional petition to make repairs only to Sunset Strip it was disclosed that it is possible, but the process would take longer as it would be necessary to file a new petition as step one of the intended process.  

Tom Fudala noted that if reconstruction was considered solely on Sunset Strip then only Sunset Strip would pay the betterment.  As a result, and with fewer homes, the betterment would be much larger for the homeowners.

Julie Mauro 90 Sunset Strip stated that if Sunset Strip were to be the only road bettered, it would be plowed as a town road and secondary roads would not be plowed.  And, if the area had a proper home association, the road conversion could have been done years ago.  Ms. Mauro added that it is not just one street that is affected in this subdivision.

Carl Wilson 35 Claulise Lane asked about the value of the area homes.  It was noted the betterment would add to the value of the referenced properties.

Tom Fudala stated that previously, the proposal specified 45,000 sq. ft. of hydro-seed.  He asked why it is being done.  In response it was stated the hydro-seeding would correct any disturbance as it is the intention of the Town to return the area to its original state after construction.  Mr. Fudala indicated that a lot of shrubs are in the right-of-way.   The DPW Director stated there is generally disturbance beyond the existing right-of-way.  Betterment funds are detailed in the budget specification to loam and reseed the disturbed areas.  And, as per the Snow Plow Policy shrubs, and overhanging plant material must be pruned.

Selectman Cotton indicated that he went through process in his neighborhood and reaffirmed the need for hydro-seed to bring the area to its former condition.

R Jacobson 50 Wilann Road asked if there would be any change in the property lines to existing homeowners.  The response indicated there would not be any change to the property delineations.

Ralph Barbaro, 96 Sunset Strip, a new resident of the Town of Mashpee indicated that he has background experience in this process within the State of New York.  With regards to the matter of snow plowing, Mr. Barbaro stated he has never heard of not plowing a road if it is a private road.  It was noted that he received indication the town was not going to plow his road.   Mr. Barbaro was informed by the Board that this was not a topic of discussion on tonight’s agenda.  Mr. Barbaro stated the town is in need of a road improvement program.  He was informed by the Town Manager that to bring the road to current standards, the town had to put you on notice to bring the road to current standard.  Debating the matter, Mr. Barbaro indicated the town has the responsibility not matter who owns the road.  It was disclosed in the matter of public safety, the town would provide access and response in an emergency situation.

The Board was asked about the road that lies between Noisy Hole Road, and if it is the town’s intention to make road improvements.  The road is unpaved and lacks drainage.  It is comprised of dirt for approximately 1/8th of a mile.  The DPW Director indicated this area is not part of the road taking.  Ms. Laurent indicated the road of discussion was created to connect the two neighborhoods and it seemed unfair to better the road, and charge the area residents.  However, the Board of Selectmen agreed to review cost estimates with respect to this regard.

Julie Mauro stated that she has been a resident of Sunset Strip for the past twelve years.  With all this talk of public safety and plows, she receives a letter each year about drains, and brush.  With this action, we would be doing what we have been told to do over the years.  For additional comparison, Ms. Mauro recommended the residents review the neighborhoods and road areas previously taken by the town.  It was noted that five years ago the betterment cost was $8,200 and now it is $11,000 per property owner.

Diane LeBlanc, 27 Claulise asked what percentage of taxes are earmarked for road repair.  Joyce Mason, Town Manager indicated the funding derives from DPW operations.  The insert with the tax bill contains a breakdown of the percentage.  It was noted the property value on a private road is different than a public road.  There was a question regarding safety.  It was explained in the event of emergency, the town would provide response.  A resident for the past 25 years stated that she has never see the road plowed sufficiently for an ambulance to pass through.  In her opinion, there are safety issues.

Kevin Cahill 136 Sunset Strip indicated that he sent a letter in support of the takeover.  In discussions with the Town Assessor, Jason Streebel, the residents would receive their first betterment assessment with their tax bill in January 2017.  Of the 75 property owners, the Mashpee Wampanoag Tribe owns property and would be bettered as well.  Information with respect to this regard would be provided from the Selectmen’s Office.

Denise Holbrook a resident of 49 Wilann Road asked about the betterment if the property was to be sold.  In response, the Town Manager indicated the betterment assessment balance would be between the seller and the buyer; the betterment may or may not be paid in full.  If the betterment is not paid in full at the time of the sale, normal process would place a lien on the subject property.

Tom Fougere of Noisy Hole Road asked about the petition process.  It was disclosed that it is necessary to obtain a minimum of 50% of the property owners to sign the second petition.  It was noted that a resident of Sunset Strip will spearheaded this endeavor.

When asked about paying for the betterment, it was noted that if betterment paid in full, the 5% interest obligation would be paid as well.

Discussion followed with regards to the matter of school buses.  It was noted the School Department has communicated to area residents that the road condition is deemed a safety issue.  Handicapped buses go to the houses if they can.  One resident stated that “we created this problem, and we need to solve it.  If we started a homeowners association when it was built, we could have paid this.  There is so much there that you are not aware of to fix.”

Sheila Roche 30 Wilann Road asked if the gate could be open on Noisy Hole for access.  The reply was no, it cannot be opened.  Discussion followed with respect to plowing and sanding.  There was concern with regards to future maintenance needs if the Town was to take over the road.  It was noted the DPW Director is expected to present a Pavement Management Plan to the Selectmen tonight to alleviate any budget concerns.  Regarding the pay-off of the betterment, the homeowner may choose the option that is best suited to their needs.

Merope Deluca a resident of 96 Wilann stated she has tenants who are moving out and made note of a sign that was posted in the neighborhood requesting funding.  It was stated that money is being collected by the person who does not want the town to take over the road.  If the project is approved at town meeting, temporary repairs would be conducted on Sunset Strip before the onset of winter to allow for road plowing.  

Kevin Springer 17 Claulise asked about the numbers quoted.  It was recommended he contact the Board of Selectmen’s Office in the morning for exact figures.

Being no further comment, the Board motioned to close the Public Hearing.

The Board of Selectmen opened the Public Hearing on the private to public road conversion of the following road: Anthony’s Way as shown on plans entitled “Anthony’s Way Easement Taking Plan”, prepared by Baxter NYE Engineering and Surveying, dated January 29, 2015.

The Hearing notice was read aloud into the record in accordance with posting requirements.

It was disclosed the total estimated betterment cost is $45,121.65.  The maximum cost to be borne by each of the (7) property owners is $6,445.95.  This is the maximum allowable charge by the Town of Mashpee for this betterment.

        The Board of Selectmen opened the Public Hearing to solicit comment.

Warren Mekjian of 9 Anthony’s Way asked about the road surface overlay.  The Director of Public Works indicated that she is proposing to mill the ten-year old road 1 ½” and to resurface the road overlay 1 ½” to bring the road to standard condition before it is acquired by the Town of Mashpee.

Being no further comment, the Board motioned to close the Public Hearing.

        Inter-municipal Agreement – Upper Cape Regional Transfer Station:

Catherine Laurent, Director of Public Works discussed her memorandum of May 18, 2015 relative to the proposed Inter-municipal Agreement for the Upper Cape Regional Transfer Station (UCRTS) due to expire on June 30, 2015.

As noted, the four Upper Cape towns; Mashpee, Falmouth, Bourne and Sandwich have consent to the referenced property, owning the building and improvements to the site.
The Board of Managers of the four Upper Cape communities recently awarded a contract with Weston & Samson Engineers, Inc. to conduct a feasibility study to consider additional uses for the property.  It is anticipated the study would be completed by the end of September, 2015.

        Inter-municipal Agreement – Upper Cape Regional Transfer Station: (continued)

Since the Upper Cape towns have authorized the review of potential uses of the property, located on Joint Base Cape Cod, it is recommended the participating Town’s renew their ownership.  Ms. Laurent indicated the regional communities have been working with MA Development, and they are supportive of the Town’s continued use of the property.  Representatives from 102nd Intelligence Wing are also supportive of the study.  It was noted there is also funding, approximately $200,000 reserved for capital improvement.

Ms. Laurent indicated the term of the IMA is three years, which should allow for sufficient time to obtain approvals, permitting and financing as necessary for any future use of the property.  Although this is a unique situation, there is consensus the property retains value.  The property was used as a rail station transfer for trash, and has been inoperative since December 31, 2014.

In addition, Ms. Laurent noted the Town’s may not require this property for the transfer of trash.  There is benefit for C & D transfer, recycling, and the transfer of recycling although the process could take 3+ years.  Currently, there is no cost to the Town of Mashpee, and the feasibility study has been grant funded.  The four managing town’s would jointly review the proposal.  The new IMA was drafted by the Town of Mashpee and the Town of Sandwich Town Counsels.

        Street Light Committee Recommendations:

        Catherine Laurent, Director of Public Works was in attendance to recommend the Board    
accept the existing street light located on Route 130 at the intersection of Birch Way, and on Canonchet Avenue at the intersection of Cayuga Avenue as Town lights.

At their meeting of May 7, 2015 the Street Light Committee voted to recommend their acceptance.  Upon approval, the Town would convert the fixtures to LED through the Cape Light Compact.  With the conversion to LED, the total annual cost of each light is approximately $30.

Motion made by Selectman Gottlieb to support the recommendation of the Street Light Committee to accept the (2) Street Lights as referenced.

        Pavement Management/Budget Report:

The DPW Director met with the Board of Selectmen and representatives from Fay, Spofford & Thorndike; FST Engineers for the purpose of reviewing the 2015 Pavement Management Report and proposed maintenance budget.  In addition to Ms. Laurent, FST representatives present were Douglas Prentiss, Bill Scarpati, and Raman Josen.

It was explained the Town has accepted 42 miles of local or neighborhood roads over the years that historically have been maintained through the expense budget of the Department of Public Works.  Main roads are funded through Chapter 90 or through the TIP process.

FST data was collected on 42.3 miles of local streets to calculate a pavement condition index (PCI).  It was determined the average PCI in Mashpee is 80.4 for the entire network of roads.  This is considered to be “good” condition from the standpoint of pavement management, a strategy that involves allocating funding at opportune times to achieve the optimal results.

Although the roads are deemed in good condition, there is a current pavement repair backlog of the local network roads in the amount of $1,356,164.

The Board of Selectmen reviewed the funding scenarios under consideration over the next 10 years.  FST has recommended the Town follow a 3-Year Aggressive Scenario to improve the local network to “excellent” conditions and maintain the backlog to a sustainable level.  The 3-Year Aggressive Scenario allocated $500 k. per year for the first three-years, and $165 k. per year for the following seven-years.  The PCI would increase to 90 while the backlog would remain at $1.4M.

        Discussion followed with respect to potential funding sources.

Motion made by Selectman Gottlieb to tentatively support the 3-Year Aggressive Scenario, and looks towards funding initiatives with the new Town Manager.

        Vehicle Bid Recommendations for Acceptance:

The FY16 Capital Improvement Plan (CIP) approved at the October 2014 Town Meeting authorized the purchase of one pick-up truck, two small dump trucks, and one 15-passenger van, respectively for the DPW, Town Hall, and Recreation.

Through the general bid process, bids were received for the 2016 Ford F250 and two 2016 Ford F550 trucks, and it was disclosed the prices offered for the trade-in of the vehicles were recommended for acceptance.

At this time, it is the recommendation of the DPW Director to await the bid results from the state bid for the purchase of the recreational passenger van.  On this date, it was confirmed the state bid would be lower.  It was therefore the recommendation of the DPW Director to defer acceptance of the recreational passenger van bid to await final state bid results.

        OLD BUSINESS:

        Reaffirmation of Town Manager Appointment:

For the record, Selectman Cahalane indicated the Board’s decision to appoint the Town Manager following the Town Manager interview process was premature, and as such the Board of Selectmen will reaffirm the appointment this evening.

The Board of Selectmen previously agreed to re-affirm their decision of May 27, 2015 to appoint Rodney Collins as the new Town Manager at the next regularly scheduled Selectmen’s Meeting.  It was noted that Town Counsel also advised the Board to take formal action on this appointment at their June 1, 2015 meeting.

It was stated that Town Counsel, Patrick Costello will be conducting a training seminar regarding the Open Meeting Law for all Boards and Committees at the Mashpee Town Hall in the near future.

Motion made by Selectman O’Hara to appoint Rodney Collins of Mashpee as the new Town Manager of the Town of Mashpee.

        Permission Request for Beach Fire/50th Anniversary Clambake Party-June 13, 2015:

Correspondence was received from Michael Wolly via email dated May 18, 2015 requesting permission to hold a beach bonfire on June 13, 2015 for a 50th anniversary clambake.  The email notification indicated the applicant was unable to attend the Selectmen’s Meeting to further discuss this request.  The applicant did state in his email that all precautions would be made on the day of the event, and the beach would be restored to its original state that same evening.

It was noted the applicant is renting at 15 Cross Street, Mashpee, and anticipates holding the bonfire at the semi-private beach across the street.  However, the actual site location was not detailed.

Amy Rullo, President of the Quashnet School PTO was in attendance to request the Board approve the Special Events Application to hold a Quashnet Falcon 5k Color-a-thon fundraiser on Saturday, June 13, 2015.  The race is scheduled to begin at the Quashnet School at 8:30 a.m.  Set-up is planned for 6:30 a.m., clean-up planned after 12:00 p.m.

Correspondence was received from Arden Cadrin dated May 14, 2015 requesting to be considered as Mashpee’s representative to the Advisory Council of the Barnstable HOME Consortium.  Ms. Cadrin has been working in the affordable housing field for the past twenty years, and has served as the Program Coordinator for HOME.

Motion made by Selectman Gottlieb to appoint Arden R. Cardin as Mashpee’s representative to the Barnstable HOME Consortium for a three-year appointment effective July 1, 2015.

        Acceptance of 3-Year Bid for Beach Concession from Perry’s Last Stand:

The Board of Selectmen received a bid quotation from Winterbottom Ice Cream d/b/a Perry’s Last Stand in response to advertisement for beach concessions.  This year, the Splash Pad at Heritage Park is included in the bid which also includes concessions at South Cape Beach, John’s Pond Park, and Attaquin Park.  The quote for 2015 is $4,000.

For the past three years Perry’s Last Stand has held the concession bid in the Town of Mashpee without incident.
